How long can you not have insurance in California?
As a California resident, you should carry insurance throughout the year with no gaps in coverage of 90 days or more. Otherwise, you may face a tax penalty when you file your tax return. There are some exemptions to California's penalty, which we'll discuss later.
Exemptions You Can Claim When You File State Taxes
A short coverage gap of three consecutive months or less.
At $996 per year, that is only about $83 per month. If you compare that penalty with paying a theoretical $375 a month for a Covered California plan, it may make sense to pay the tax penalty for no health insurance.
No Insurance
If you're not insured and get in an accident, your driver's license will be suspended for four years. After one year, it may be returned if you provide proof of insurance to the DMV, and maintain it for the next three years.
If you're caught driving without insurance, you can be fined, your vehicle could be impounded, and your license and registration could be suspended. For the first offense, you could pay a fee of $100 to $200. For the second offense, that's between $200 to $500, according to Kelly Blue Book.
The ACA's federal tax penalty for not having minimum essential coverage was eliminated after the end of 2018, under the terms of the Tax Cuts and Jobs Act of 2017. Technically, the coverage requirement is still in effect, but there's no longer a federal penalty for non-compliance.
Do I have to buy health insurance? You do not need to buy insurance now. But beginning in 2014, most people must buy health insurance. Health insurers will also no longer be able to deny your application.
Make sure you have health care coverage
To avoid a penalty, you need minimum essential coverage (MEC) for each month of the year for: Yourself. Your spouse or domestic partner. Your dependents.
In a worst-case scenario, you could be sued and have your wages garnished. You might even be forced into bankruptcy. The Commonwealth Fund's 2023 Health Care Affordability Survey found that 38% of people surveyed said they delayed or skipped needed healthcare or prescription drugs because they couldn't afford it.
For many individuals who enroll in Medi-Cal, there is no premium, no co-payment, and no out of pocket cost. Some households will see affordable costs, such as a low monthly premium. For some Medi-Cal children, the monthly premiums are $13 per child up to a family maximum of $39 per month.
Is driving without insurance a felony in California?
Driving without insurance is an infraction and is punishable be a fine between $100 and $200 plus any other state assessments and fees. However, if the driver is ticketed a subsequent time for driving without insurance within 3 years of the first infraction, then the fine will be between $200 and $500.

Driving without insurance in California is a violation of California Vehicle Code Section 16020–16033 . Potential Penalties? First offense: Minimum fine of $100. Additional fees and penalty assessments will result in a total fine of about $450 .
Individual Mandate
Most people in California are required to have health coverage. If you do not have health coverage you may have to pay a tax penalty. This is called the “individual mandate.”
The penalty for not having coverage the entire year will be at least $900 per adult and $450 per dependent child under 18 in the household when you file your 2023 state income tax return in 2024.

However, there is no federal nationwide mandate. In California, the penalty is at least $850 for adults and $425 for dependent children under 18, which would be paid on their state income tax return for the 2023 tax year in 2024.

As of 2022, only five states (California, Massachusetts, Rhode Island, New Jersey and Vermont) and the District of Columbia require all eligible residents to declare annual proof of health insurance coverage on state taxes.

In general, you do not need to worry about reporting your health insurance on your IRS return unless you or a family member purchased a plan through the Healthcare Marketplace and received a 1095-A.
